These Text Alerts Terms and Conditions ("Terms") apply to your use of the AAA Club Alliance Inc. (“ACA”) Discount and Travel Text Alerts services (the "Services"). If you choose to receive any of the Services you will be getting texts from an automatic dialing system. By texting in your request to receive the Services, you are providing express consent to receive the applicable Text Alerts.
NOTE: Roadside Assistance ETA status update (AAASERVICE) text alerts that you opt-in to receive are governed by AAA National’s Terms and Conditions which are available at www.AAA.com/smsterms.
AAA DISCOUNT TEXT ALERTS:
Commencement and Duration of Discount Text Alerts Service:
You can commence receipt of AAA Discount Text Alerts by texting the service request term (AAASAVE) to the short code 87255. Subscribers will receive up to 5 AAA Discount Text Alerts per month.
AAA TRAVEL TEXT ALERTS:
You can commence receipt of AAA Travel Text Alerts by texting the service request AAA TRAVEL to the short code 87255. Subscribers will receive up to 5 AAA Travel Text Alerts per month.
CANCELLATION OF ANY TEXT SERVICE:
To opt out of future messages at any time, you may text: STOP to 87255.
FOR HELP:
Text HELP to 87255 or reply HELP to any text message. All text messages will be in English.
CHARGES
The Services are provided by ACA without charge. However, depending on the terms of your wireless plan, text message or other fees may be charged by your wireless carrier for sending and/or receiving these messages. Please contact your wireless service provider if you have any questions about your SMS and wireless data plan. You warrant that you are the owner or authorized users of the cellular number that you provide, and are authorized to incur any wireless charges from your use of the Services.
CHANGES TO CELL PHONE NUMBERS
If you are changing or terminating your use of your cell phone number, before changing or terminating your cell phone number, you agree to reply STOP to our Text Alerts to prevent subsequent users of that cell phone number from receiving text messages for the Services and being charged.
NON-COMMERCIAL USE ONLY
The Services is intended for your personal, non-commercial use only. You agree that you will not copy, re-transmit, broadcast or make any commercial use of the Services. But you are not required to give your consent to receive Text Alerts as a condition to purchasing any property, goods or services, or to use any of the discounts offered by ACA.
All texts and other content provided by the Services are protected by copyright, trademarks, trade secrets, patents, and other intellectual property ("Intellectual Property") laws. You do not have any license or permission to use the Services except as expressly permitted under these Terms.
PERMITTED AND PROHIBITED USES
You may not under any circumstance use any device, software, or technique that (a) attempts to access our systems, or reverse engineer, decrypt, break or otherwise alter or interfere with the Services; or (b) creates undue burden or other interference of the Services or the system that support it.
PRIVACY
ACA will collect only your designated telephone number, the name of your wireless carrier, and ZIP code (the “Personal Information”) in connection with the Services. ACA will use the Personal Information we collect from you in connection with your electing to receive the Services only for purposes of providing the Services to you. ACA may share your Personal Information with our service providers as reasonably required to provide the Services. We will process, store and share your information in accordance with ACA’s Privacy Policy which is available at https://cluballiance.aaa.com/About/Privacy.
NO WARRANTIES
There is no warranty that the Services: (a) will be complete or accurate at any particular time, (b) will fulfill any of your particular purposes or needs, or (c) will be available or operate without interruption. The Services are provided "as is" and without any warranties or representations of any kind, express or implied.
LIMITATION OF LIABILITY
ACA assumes no liability or responsibility for any errors or omissions in connection with your use of the Services. IN NO EVENT SHALL ACA, OUR AFFILIATES, OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR DAMAGES FOR COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS OR SERVICES, LOSS OF PROFIT, LOSS OF REVENUE, DATA, GOODWILL OR USE INCURRED BY YOU OR ANY THIRD PARTY, ARISING OUT OF, OR CONNECTED WITH YOUR ACCESS TO, USE OR INABILITY TO USE, OR DELAY IN USE OF THE SERVICES, ANY DEFECT, OMISSION, ERROR, INTERRUPTION, OR VIRUS, OR ANY MATERIAL, PRODUCTS, OR SERVICES OBTAINED THROUGH THE SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY THEORIES, OR OTHERWISE, EVEN IF ACA OR ANY OF OUR SERVICE PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
MODIFICATIONS OF SERVICE; TERMINATION
We may modify or terminate the Services at any time without notice.
These Terms are effective as of November 1, 2011 as modified as of July 2, 2018. These Terms are subject to change.
