AAA Club Alliance Leisure Travel Booking Site Terms of Use

American Automobile Association, Inc., AAA Club Alliance Inc., and their respective parents, subsidiaries and affiliates (collectively “AAA”) require that all visitors to their leisure travel related sites on the World Wide Web accessible from www.aaa.com (each such site a “Leisure Travel Booking Site”) adhere to these Terms of Use. By accessing, using or obtaining any content, products, or services through the Leisure Travel Booking Site, you agree to be bound by these Terms of Use and any other terms and conditions provided on the Leisure Travel Booking Site. AAA acts solely as sales agent for the air carriers, hotels, car rental agencies, cruise lines, tour operators and other suppliers providing travel products, travel services or other services on the Leisure Travel Booking Site (“Supplier”/collectively “Suppliers”). By purchasing travel products, travel services or other services on the Leisure Travel Booking Site, you understand that the product and/or service will be provided by the Supplier and not AAA. These Terms of Use are in addition to any Supplier terms and conditions applicable to your purchase. You are responsible for reviewing and familiarizing yourself with such Supplier terms and conditions.

1. Laws and Regulations. Your access to and use of the Leisure Travel Booking Site at all times remains subject to applicable international, federal, state and local laws and regulations.

2. Fraudulent Transactions. Under no circumstance may you make a purchase using the Leisure Travel Booking Site unless you provide your valid credit/debit card account information including account number and expiration date. It is a violation of law to engage in fraudulent purchases. Please be aware that even if you do not give us your real name, your Web browser transmits a unique Internet address to us that can be used by law enforcement officials to identify you. Fraudulent users will be prosecuted to the fullest extent of the law.

3. Relationship. Your acceptance of these Terms of Use and your use of the Leisure Travel Booking Site do not create a joint venture, partnership, employment, or agency relationship with us. You may not assign, delegate, or transfer your rights or obligations under these Terms of Use.

4. Use of Leisure Travel Booking Site. You may only use the Leisure Travel Booking Site in connection with making legitimate reservations or purchases and shall not use the Leisure Travel Booking Site for any other purposes, including but not limited to, making any speculative, false or fraudulent reservation or any reservation in anticipation of demand. You may not (i) use any automatic device, or a similar program, algorithm or methodology, or any manual process to monitor or copy any of the Web pages, data or content found on the Leisure Travel Booking Site, (ii) deep link to any portion of the Leisure Travel Booking Site in the absence of prior written consent of AAA, or (iii) use the Leisure Travel Booking Site in violation of, or to violate, any law, rule or regulation.

You acknowledge that you will be responsible for all charges, fees, duties, taxes and assessments arising out of your use of the Leisure Travel Booking Site.

5. GENERAL LIMITATION OF LIABILITY. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AAA, INCLUDING ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, DISTRIBUTORS, OR OTHERS INVOLVED IN CREATING, SPONSORING, PROMOTING, OR OTHERWISE MAKING AVAILABLE THE LEISURE TRAVEL BOOKING SITE AND ITS CONTENTS AND DATA, OR THE SUPPLIERS (EACH A “COVERED PARTY” AND COLLECTIVELY THE "COVERED PARTIES") BE LIABLE TO ANY PERSON OR ENTITY WHATSOEVER FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, COMPENSATORY, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO: (I) LOSS OF GOODWILL, PROFITS, BUSINESS INTERRUPTION, DATA OR OTHER INTANGIBLE LOSSES; (II) YOUR INABILITY TO USE, UNAUTHORIZED USE OF, PERFORMANCE OR NON-PERFORMANCE OF THE LEISURE TRAVEL BOOKING SITE; (III) UNAUTHORIZED ACCESS TO OR TAMPERING WITH YOUR PERSONAL INFORMATION OR TRANSMISSIONS; (IV) THE PROVISION OR FAILURE TO PROVIDE ANY SERVICE; (V) ERRORS OR INACCURACIES CONTAINED ON THE LEISURE TRAVEL BOOKING SITE OR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS OBTAINED THROUGH THE LEISURE TRAVEL BOOKING SITE; (VI) ANY TRANSACTIONS ENTERED INTO THROUGH THE LEISURE TRAVEL BOOKING SITE; (VII) ANY PROPERTY DAMAGE INCLUDING DAMAGE TO YOUR COMPUTER OR COMPUTER SYSTEM CAUSED BY VIRUSES OR OTHER HARMFUL COMPONENTS, DURING OR ON ACCOUNT OF ACCESS TO OR USE OF THE LEISURE TRAVEL BOOKING SITE OR ANY SITE TO WHICH THE LEISURE TRAVEL BOOKING SITE PROVIDES HYPERLINKS; OR (VIII) DAMAGES OTHERWISE ARISING OUT OF THE USE OF THE LEISURE TRAVEL BOOKING SITE, ANY DELAY OR INABILITY TO USE THE LEISURE TRAVEL BOOKING SITE, OR ANY INFORMATION, PRODUCTS, OR SERVICES OBTAINED THROUGH THE LEISURE TRAVEL BOOKING SITE. THE LIMITATIONS OF LIABILITY SHALL APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF AAA OR A COVERED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.  

6. NO WARRANTIES. TO THE EXTENT PERMITTED BY LAW, AAA AND THE COVERED PARTIES MAKE NO WARRANTY OF ANY KIND REGARDING THE LEISURE TRAVEL BOOKING SITE AND ANY CONTENT OR DATA PROVIDED ON THE LEISURE TRAVEL BOOKING SITE, ALL OF WHICH ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. AAA AND THE COVERED PARTIES DO NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENCY OR RELIABILITY OF ANY OF THE CONTENT OR DATA FOUND ON THE LEISURE TRAVEL BOOKING SITE AND EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. AAA AND THE COVERED PARTIES DO NOT WARRANT THAT THE LEISURE TRAVEL BOOKING SITE, ITS SERVERS OR ANY E-MAILS SENT FROM AAA OR A COVERED PARTY ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WITHOUT LIMITING THE FOREGOING, NO WARRANTY OR GUARANTEE IS MADE (I) REGARDING THE PURCHASE OF ANY PRODUCT OR SERVICE THROUGH THE LEISURE TRAVEL BOOKING SITE, (II) THAT YOU WILL RECEIVE THE LOWEST PRICE AVAILABLE FOR GOODS AND/OR SERVICES AVAILABLE THROUGH THE LEISURE TRAVEL BOOKING SITE, (III) REGARDING THE AVAILABILITY OF PRODUCTS AND/OR SERVICES THROUGH THE LEISURE TRAVEL BOOKING SITE, (IV) THAT USE OF THE LEISURE TRAVEL BOOKING SITE AND ALL PRODUCTS OR SERVICES ASSOCIATED WITH THE LEISURE TRAVEL BOOKING SITE WILL BE ERROR FREE, (V) REGARDING THE RESULTS THAT MAY BE OBTAINED USING THE LEISURE TRAVEL BOOKING SITE, (VI) REGARDING THE COMPLETENESS, ACCURACY, RELIABILITY OR QUALITY OF ANY INFORMATION, CONTENT, DATA, SERVICE, PRODUCT, MERCHANDISE OR ADVICE PROVIDED OR MADE AVAILABLE THROUGH THE LEISURE TRAVEL BOOKING SITE, (VII) REGARDING THE PERFORMANCE OR NON-PERFORMANCE OF THE LEISURE TRAVEL BOOKING SITE.

AAA IS UNDER NO OBLIGATION TO UPDATE ANY CONTENT ON THE LEISURE TRAVEL BOOKING SITE. AAA MAY CHANGE THE CONTENT ON THE LEISURE TRAVEL BOOKING SITE AT ANY TIME WITHOUT NOTICE, AND MAY MAKE IMPROVEMENTS OR CHANGES TO THE LEISURE TRAVEL BOOKING SITE AT ANY TIME.

If, notwithstanding the above, AAA is found liable for any loss or damage relating to use of the Leisure Travel Booking Site, you agree that the liability shall in no event exceed the greater of (i) the transaction service fee you paid to AAA for your transaction on the Leisure Travel Booking Site, or (ii) US$100.00.

7. LIMITATION OF LIABILITY FOR SERVICES ARRANGED THROUGH THE LEISURE TRAVEL BOOKING SITE. SUPPLIERS ARE INDEPENDENT CONTRACTORS OF AAA, ARE NOT EMPLOYEES OR AGENTS OF AAA, AND AAA ACTS SOLELY AS A SALES AGENT FOR THE SUPPLIERS. AAA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES: (A) ARE NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, OR NEGLIGENCE OF ANY SUCH SUPPLIERS OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFROM; (B) HAVE NO LIABILITY AND WILL MAKE NO REFUND IN THE EVENT OF ANY DELAY, CANCELLATION, OVERBOOKING, SHORTAGES, SICKNESS, PILFERAGE, LABOR DISPUTES, STRIKES, MACHINERY BREAKDOWN, QUARANTINE, GOVERNMENT RESTRAINTS, WEATHER, FORCE MAJEURE OR OTHER CAUSE BEYOND AAA’S DIRECT CONTROL (EXCEPT WHERE REQUIRED UNDER APPLICABLE CONSUMER PROTECTION LAW), AND THEY HAVE NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, RE-ROUTING OR ACTS OF ANY GOVERNMENT OR AUTHORITY. THE FACT THAT AAA INCLUDES OR OFFERS ANY PRODUCT OR SERVICE ON THE LEISURE TRAVEL BOOKING SITE DOES NOT MEAN THAT AAA IS ENDORSING OR RECOMMENDING SUCH PRODUCT OR SERVICE.

8. Indemnification. To the extent permitted by law, you agree to defend and indemnify AAA and the Covered Parties from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought: (i) by you or on behalf of you in excess of the liability described above; or (ii) by third parties as a result of your breach of these Terms of Use, your violation of any law or the rights of a third party, your use of the Leisure Travel Booking Site.

9. Third Parties. If you use the Leisure Travel Booking Site to purchase products or services for or on behalf of a third party, you are responsible for any error in the accuracy of information provided in connection with such use. In addition, you must inform the third party of all rules and restrictions applicable to products and services purchased through the Leisure Travel Booking Site, including but not limited to these Terms of Use.

10. Age and Responsibility. You represent that you are of sufficient legal age to use the Leisure Travel Booking Site and to create binding legal obligations for any liability you may incur as a result. Minors (as defined under the laws of their jurisdiction or residence) are not eligible to book the products or services available on the Leisure Travel Booking Site.

11. Trademark/Copyright Notice. The trademarks, logos and service marks ("Marks") displayed on the Leisure Travel Booking Site are the property of AAA, Suppliers or other parties. (“Automobile Association of America”, “AAA”, “Triple A”, “Three A” or “Three A’s” are trademarks of AAA.) Users are prohibited from using any Marks for any purpose, including, but not limited, to use as metatags on other pages or sites on the World Wide Web without the written permission of AAA or such third party which may own the Marks. The use on the Leisure Travel Booking Site of any Mark of or belonging to any Supplier or other third party, and the availability of specific goods or services from such third party through the Leisure Travel Booking Site, should not be construed as an endorsement or sponsorship of such third party by AAA or of AAA by such third party. All information and content including any software programs available on or through the Site (the "Content") is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Leisure Travel Booking Site for commercial or public purposes. Without limiting the foregoing, reproductions or storage of Content retrieved from the Leisure Travel Booking Site, in all forms, media and technologies now existing or hereafter developed, is subject to the U.S. Copyright Act of 1976, Title 17 of the United States Code.

12. User Personal Information/Comments. Our collection of user personal information through the Leisure Travel Booking Site and disclosure of such information to third parties is subject to our Privacy Policy https://cluballiance.aaa.com/About/Privacy. Notwithstanding the foregoing, user postings made on the Leisure Travel Booking Site, including any data, question, comments, suggestion, idea, or the like (collectively “Comments”) will be treated as non-confidential and non-proprietary. By posting any Comments on the Leisure Travel Booking Site, you grant to AAA and all users of the Leisure Travel Booking Site a worldwide, non-exclusive, royalty free, perpetual, irrevocable, and fully sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Comments in any form, media or technology. You are solely responsible for the content of any Comments you make.

13. Privacy Policy. Your use of the Leisure Travel Booking Site is subject to our Privacy Policy https://cluballiance.aaa.com/About/Privacy, which is expressly incorporated herein by reference. Without limiting the foregoing, your acceptance of these Terms of Use also constitutes your acceptance of the information practices detailed in our Privacy Policy.

14. Transmission of Personal Data. You acknowledge and agree that by providing AAA with any user personal or proprietary information through the Leisure Travel Booking Site (including, but not limited to, credit or debit card account information) you consent to the transmission of such personal or proprietary user information: (i) between American Automobile Association, Inc., AAA Club Alliance Inc., and their respective parents, subsidiaries and affiliates; and (ii) over international borders as necessary for processing in accordance with AAA’s and/or the Supplier’s standard business practices. Our use, storage and disclosure of your personal and proprietary information is subject to our Privacy Policy https://cluballiance.aaa.com/About/Privacy. You should be aware that Linked Sites (as described in Section 15, below) may contain transmission of personal data provisions that differ from the provisions provided herein. AAA is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions.

15. Links to Other Web Sites and Services. To the extent that the Leisure Travel Booking Site contains a link to an outside Web site (a “Linked Site”), any concerns or issues regarding the Linked Site, or the products, services or resources on the Linked Site, should be directed to the particular Web site owner, or product, service or resource provider. The fact that AAA has provided a link to a Web site is not an endorsement, authorization, sponsorship, or affiliation with respect to such site, its owners, or its providers. There are inherent risks in relying upon, using, or retrieving any information found on the Internet, and AAA urges you to make sure you understand these risks before relying upon, using, or retrieving any such information on a Linked Site. AAA does not guaranty or warrant the accuracy or completeness of information or content on a Linked Site. Users should be aware that Linked Sites may contain rules and regulations, privacy provisions, confidentiality provisions, transmission of personal data provisions, and other provisions that differ from the provisions provided on the Leisure Travel Booking Site. AAA is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions.

16. Termination of Usage. Your access to and use of all or part of the Leisure Travel Booking Site may be terminated or suspended at any time, without notice and for any reason, or for no reason.

17. Passengers' Legal Names. For international travel, the names entered in the reservation should be spelled as they appear on the document(s) that will be used for proof of citizenship (e.g., a passport). For domestic travel, the names entered in the reservations should match the government-issued photo identification that will be used for travel; all air travelers 18 years of age or older on the date of travel are required to present a government-issued photo identification. Those on honeymoon cruises should ensure that any maiden name reflected on their travel documents (e.g., a passport) matches the name on their cruise documents.

18. Verify All Information. Please verify all information on your receipt for accuracy and completeness, and check the spelling of all names carefully. Notify a AAA travel agent immediately if any changes or corrections are needed, by calling 1-800-436-4222.

19. Read Cruise Line's Information or Brochures Carefully. The cruise line information presented on the Leisure Travel Booking Site or cruise line brochures contains important information concerning your vacation. Review the cruise line's terms and conditions, particularly policies concerning cancellation penalties. If applicable, locate your cabin to verify its location and bedding options. Compare ship, sailing dates, and itinerary on your receipt with the cruise lines' current brochure or Web site for accuracy. Cruise line brochures may be requested through your AAA travel agent, excluding certain cruise lines which do not print a brochure. Itineraries are subject to change without notice by the airline, cruise line or other Supplier.

20. International Travel Documentation Requirements. Travelers desiring transportation across any international boundary are responsible for obtaining all necessary travel documents and for complying with all government travel requirements. You must present all exit, entry and other documents required by law. AAA shall not be responsible to you for any loss or expense due to your failure to comply with such requirements. Suppliers reserve the right to refuse carriage to any passenger who has not complied with applicable laws, regulations, orders, demands, or requirements or whose documents are not complete. It is your responsibility to research the travel documentation requirements applicable to your journey. For U.S. citizens, information regarding country-specific documentation requirements is available from the U.S. Department of State, at http://www.state.gov/travel/. Non-U.S. citizens should contact their government’s embassy or consulate for further information. AAA shall not be liable for any aid or information given by any agent or employee of AAA to any passenger in connection with obtaining such documents or complying with such laws, whether given orally or in writing or otherwise. For U.S. passport holders, many countries require that your passport be valid for at least six (6) months from your date of entry at the foreign point and/or three (3) months beyond your planned departure date from the foreign country. Country-specific passport validity requirements for U.S. passport holders are accessible at http://travel.state.gov/content/passports/english/country.html.

21. Travel to Certain Destinations. Most travel, whether domestic or international, is completed without incident. Nevertheless, travel to certain destinations may involve more risk than travel to other destinations. AAA recommends that you review current travel alerts and warnings issued by the United States government before booking any international travel. For country-specific travel alerts and warnings, visit http://travel.state.gov/content/passports/english/alertswarnings.html. Some countries may require aircraft cabin insecticide treatment for in-bound foreign flights. A list of such countries is available at http://ostpxweb.dot.gov/policy/safetyenergyenv/disinsection.htm. AAA, by offering for sale travel to particular destinations, does not represent or warrant that travel to such destinations is safe, advisable or without risk, and AAA shall not be liable for any damages or losses that may result from travel to such destinations.

22. Supplier Terms and Conditions. You agree to abide by the terms and conditions of booking imposed by the Supplier with whom you elect to deal, including but not limited to the cruise line’s terms and conditions and airline fare rules that we make available to you before the completion of an online booking via the Leisure Travel Booking Site, and payment of all amounts when due and in compliance with the applicable Supplier’s policies, rules and restrictions regarding availability and use of fares, products and services. You understand that any violation of any such Supplier’s terms, conditions, policies, rules or restrictions may result in (i) forfeiture of any monies paid for such reservations or purchases, (ii) cancellation of your reservation or purchase, or (iii) your being denied access to any cruise, flight, hotel or other product or service.

 

23. Air/Sea Transportation. When flying to reach your port of departure, we recommend purchasing your air transportation through AAA, either during your transaction on the Leisure Travel Booking Site or by calling your AAA travel agent at 1-800-436-4222.

24. Airline Prohibited Practices. You agree not to purchase a ticket or tickets containing flight segments that you will not be using, such as a "point-beyond", "hidden-city", or "back-to-back tickets" if those practices are prohibited by the airline(s). You further agree not to purchase a round-trip ticket that you plan to use only for one-way travel if that practice is prohibited by the airline(s). You acknowledge that most airlines prohibit all such tickets, and therefore we do not guarantee that the airline will honor your ticket or tickets if you engage in these practices. You agree to indemnify AAA and the Covered Parties against airline claims, on the basis of these or any other prohibited practices, for the difference between the full fare of your actual itinerary and the value of the ticket or tickets that you purchased.

25. Travel Insurance is Strongly Recommended. Travel Insurance provides protection for the traveler in the event that the trip is canceled due to certain circumstances (for specific inclusions/exclusions, please contact 1-800-436-4222). Travel Insurance also protects in the event of most medical emergencies, and in some instances, pre-existing conditions. Some other benefits may include legal assistance, emergency medical evacuation, and travel document and ticket replacement assistance. By not purchasing Travel Insurance, you are liable for any cancellation penalties and out of pocket expenses incurred and are responsible for your own provisions in the event of an emergency while traveling.

26. Tickets and Related Documents. Tickets and related documents will be available to you approximately 2 - 3 weeks prior to the departure date via mail or electronically. In some cases, airline e-ticket confirmation documents will be provided sooner. When you receive your tickets and any and all related documents, it is the sole responsibility of the passenger named thereon to review and verify all information. Notify your AAA travel agent immediately if changes or corrections are required.

27. Cancellation. Passengers wishing to cancel a cruise reservation or other travel service or product purchased through the Leisure Travel Booking Site should notify AAA by telephone or in writing. Cancellation may result in penalties imposed by the Supplier.

28. Currency. All fees and charges are in U.S. dollars for residents of the United States, Canada and the Caribbean unless otherwise specified. Residents of all other countries are subject to rates established for those countries.

29. Changes to the Terms of Use. AAA reserves the right to revise these Terms of Use at any time and you are deemed to be aware of and subject to the Terms of Use. AAA will indicate that changes to these Terms of Use have been made by updating the “Last Modified” date indicated at the end of these Terms of Use.

 

30. Contact with Advertisers. Your dealings or correspondence with, or participation in promotions of, advertisers found on or through the Leisure Travel Booking Site (including, without limitation, payment and delivery of related products or services, and any other terms, conditions, representations or warranties associated with such dealings or correspondence) are solely between you and such advertisers. AAA makes no representations or warranties with respect to any advertising content of, or any products or services that may be obtained from, such advertisers. You agree that AAA will not be responsible or liable with respect to any loss or damage of any kind incurred as a result of (i) any such dealings or correspondence between you and such advertisers, (iii) content, products or services of such advertisers, or (iii) the presence of such advertisers on the Leisure Travel Booking Site.

31. Severability. If any provision of these Terms of Use is or becomes illegal, invalid or unenforceable under the law of any jurisdiction, such provision shall be severed from these Terms of Use in the jurisdiction in question and shall not affect the legality, validity or enforceability of the remaining provisions of these Terms of Use nor the legality, validity or the enforceability of such severed provision under the law of any jurisdiction.

32. Governing Law/Jurisdiction. To the extent permitted by applicable law, the internal laws of the State of Delaware, without regard to its conflict of law rules, shall govern these Terms of Use. You hereby consent and submit to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware, in all questions and controversies arising out of your use of the Leisure Travel Booking Site and these Terms of Use.

33. Non-Waiver. If we fail to act with respect to your breach or anyone else's breach of these Terms of Use on any occasion, we are not waiving our right to act with respect to future or similar breaches.

34. Headings. The headings in these Terms of Use are for your convenience and reference; they do not limit or affect these Terms of Use.
