1 Enhanced Flexibility is subject to additional terms and conditions as well as what is provided below:

• Rocky Mountaineer (“RM”) reserves the right to substitute Enhanced Flexibility (“EF”) with a promotion of equal or greater benefit should circumstances outside its control make this necessary.
• If for any reason, EF is not capable of running as planned for reasons beyond the control of RM, RM reserves the right to cancel, terminate, modify, or suspend EF.
• If an act, omission, or circumstance occurs which are beyond the reasonable control of RM (including but not limited to system errors, technical failures, and government interference) and which prevents RM from complying with its assurances and obligations under EF, RM will not be liable for failure to perform or delay in performance of obligations but will use all reasonable endeavors to avoid consumer disappointment.
